Welcome to Houston Embroidery Service. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By placing an order with us, you acknowledge and agree to these Terms. Please review them carefully before proceeding with any transactions.

1. Company Overview

Houston Embroidery Service is a Texas-based LLC specializing in custom clothing, custom patches, and clothing accessories for both end buyers and resellers. Our products are manufactured at our overseas facility, and all orders require full payment in advance before production begins.

2. Orders & Payments

  • All orders must be paid in full and in advance before production can commence.
  • We accept payments via major credit cards, PayPal, bank transfers, and other approved methods.
  • Orders will only be processed once payment has been successfully received and verified.
  • Prices are subject to change without prior notice.

3. Production & Turnaround Time

  • Production times vary based on product type, order size, and complexity.
  • Estimated production and delivery timelines will be provided at the time of order confirmation.
  • Houston Embroidery Service is not liable for delays caused by customs, shipping carriers, or other unforeseen circumstances beyond our control.

4. Shipping & Delivery

  • We ship worldwide using reputable carriers. Shipping costs are calculated at checkout.
  • Houston Embroidery Service is not responsible for shipping delays caused by carriers, customs clearance, or external factors.
  • Customers are responsible for any applicable customs duties, taxes, or import fees imposed by their respective countries.

5. Customization & Artwork Approval

  • All custom orders require artwork approval before production begins.
  • Customers are responsible for reviewing and approving all design details, including spelling, colors, and layout.
  • Once an order is approved and enters production, no modifications or cancellations can be accommodated.

Artwork Acceptance Policy

Houston Embroidery Service reserves the right to approve or reject any artwork submitted for production. We do not accept designs that contain:

  • Nudity or sexually explicit content
  • Alcohol-related themes or promotions
  • Gambling-related imagery
  • Drug-related content or references
  • Depictions of illegal activities
  • Hate speech, violence, or offensive material
  • Content that does not align with religious sensitivity and respect

If a submitted design is deemed unacceptable, we will notify the customer and provide the opportunity to submit a revised design.

6. Product Disclaimer

  • Handmade Variations: Due to the nature of handmade production, minor variations in stitching, alignment, and measurements may occur.
  • Material Differences: Variations in fabric texture, thickness, and composition may result in slight differences in the final product.
  • Color Representation: Colors may appear differently on screens due to individual device settings, brightness, and resolution. Additionally, variations in dye batches or materials may result in slight color differences in the finished product.
  • Measurement Tolerance: Due to manual cutting and stitching processes, minor discrepancies in measurements are possible and within an acceptable tolerance range.

7. Refunds, Returns & Cancellations

  • Due to the custom nature of our products, all sales are final, and refunds are not available.
  • Returns or replacements will only be accepted for defective or incorrect products due to our error.
  • Any issues must be reported within seven (7) days of receiving the order, accompanied by clear photographic evidence of the defect.

8. Intellectual Property

  • Customers must have the legal rights to use any logos, trademarks, or designs submitted for production.
  • By submitting artwork, the customer certifies that they either own the intellectual property or have obtained the necessary permissions from the rightful owner.
  • Houston Embroidery Service does not assume responsibility for verifying the ownership of submitted designs and shall not be held liable for any copyright or trademark infringements.
  • The customer agrees to indemnify and hold Houston Embroidery Service harmless from any claims, damages, or liabilities arising from unauthorized use of intellectual property.
  • If a third party disputes the ownership of a submitted design, production may be halted until the matter is resolved.
  • Houston Embroidery Service reserves the right to refuse production of any artwork that appears to violate intellectual property laws or pose legal risks.

9. Limitation of Liability

  • Houston Embroidery Service shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our products or services.
  • Our total liability for any claim shall not exceed the total amount paid for the order in question.

10. Privacy & Data Security

  • Customer information is collected and used in accordance with our Privacy Policy.
  • We do not sell, trade, or share customer information with third parties, except as necessary for order fulfillment.

11. Changes to Terms

  • We reserve the right to update these Terms at any time. Any modifications will take effect immediately upon posting.
